
NewJeans chose to appeal despite their loss in court. They received a ruling in favor of the plaintiff in the lawsuit confirming the validity of the exclusive contract with ADOR, and NewJeans must bear the litigation costs. On the 30th, the Civil Division 41 of the Seoul Central District Court made this decision. On that day, NewJeans members did not appear in court, and only the lawyers from both sides were present.
The court ruled that the leakage of photos and videos from NewJeans' trainee days, disparaging remarks by HYBE PR staff, the similarity issue between HYBE's label Belift Lab and I-LIT, comments by I-LIT's manager about Hani, and HYBE's pushing of albums do not constitute grounds for breach of the exclusive contract. In particular, the court rejected NewJeans' claim that Min Hee-jin's dismissal as CEO of ADOR constituted a breach of contract. The court explained, "The fact that Min Hee-jin was dismissed alone does not mean there was a gap in management," and "There is no clause guaranteeing the CEO position in the contract."
The legal representative, law firm Sejong, stated after the first trial, "The members respect the court's judgment, but given the broken trust with ADOR, returning is impossible." They announced plans to appeal, saying, "We hope the appellate court will review the facts and the legal principles regarding the termination of the exclusive contract once again."
NewJeans has experienced a hiatus of about one year and four months since 'Complex Live' held in Hong Kong last March. No albums have been released since 'Supernatural' in June last year. Some have suggested that NewJeans is more likely to appear on JTBC's 'Sugarman' than on music shows. 'Sugarman' is a program that highlights singers who were popular in the past.
ADOR expressed gratitude for the court's decision and said, "We have completed preparations for activities such as releasing a full album and are waiting. We will do our best to return to the fans through discussions with the artists." Additionally, news emerged that Min Hee-jin established a new entertainment agency, 'OK,' and completed corporate registration, leading to speculation that NewJeans would be recruited as the first artist if they won. However, with NewJeans' loss, the possibility of 'OK' becoming a space for NewJeans has diminished.
Fans have once again begun an indefinite wait. As uncertainty about NewJeans' future activities grows, fans are becoming exhausted.
